On March 27, 2024, Oregon Governor Tina Kotek signed into law the Right to Repair legislation for consumer electronics. The Right to Repair Act (SB 1596) expands consumer choice and access to repair options by requiring manufacturers to provide parts, tools, and repair information for a wider range of devices.

This law applies to a wider range of electronic devices compared to previous Right to Repair bills.  Laptops, tablets, smartphones (from July 1, 2021), game consoles (exempt), refrigerators, and other appliances with circuit boards are all covered, with some exceptions like medical devices and farm equipment. Notably, the law applies retroactively to most products manufactured after 2015, giving consumers repair options for a wider range of electronics.

The Oregon law tackles the controversial practice of “parts pairing” used by some manufacturers. Parts pairing restricts the functionality of replacement parts not obtained directly from the manufacturer. This legislation prohibits manufacturers from using parts pairing to prevent independent repair shops or consumers from fixing devices with readily available, compatible parts. 

 

Impact on Independent Repair Shops

Independent repair shops are expected to benefit significantly from the new law. The ability to access parts and service information, coupled with the limitations on parts pairing, empowers them to compete more effectively with authorized repair providers.

While some manufacturers, like Apple, who opposed the bill, raised concerns about safety and security risks, the legislation requires independent repair shops to demonstrate technical competency through industry certifications specifically naming WISE, CompTIA A+, and NAST certifications, and allowing manufacturers to accept other certifications. The parts pairing restrictions go into effect for products manufactured after January 1, 2025, giving manufacturers time to adjust their practices.
